Terms of Service

Welcome to OfferMile, a service operated by Tech Ideas LLC (“Tech Ideas,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the OfferMile platform, including the website located at offermile.com, our mobile applications, and all related services (collectively, the “Service”). By creating an account, accessing, or using the Service, you (“User,” “you,” or “your”) agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. About OfferMile

OfferMile is a two-sided marketplace that connects qualified workers in the last-mile delivery and logistics industry (“Candidates”) with companies seeking to hire them (“Companies”), and supports a referral program for service providers (“Partners”). The Service provides a platform for Candidates to create profiles, complete screenings, and receive job invitations; for Companies to search Candidate profiles, conduct interviews, and hire qualified workers; and for Partners to refer Companies and earn commissions.

Tech Ideas LLC is a Florida limited liability company with its principal place of business in Florida.

2. Definitions

“Candidate” means an individual who creates an account on OfferMile to be found and hired by Companies for delivery, logistics, dispatch, fleet management, or operations work.

“Company” means a business entity (including delivery service partners, independent service providers, courier companies, third-party logistics providers, and similar) that creates an account on OfferMile to find and hire Candidates.

“Partner” means a Founding Partner or other approved service provider that refers Companies to OfferMile in exchange for commissions.

“Verified Work History” means employment records added to a Candidate’s profile by a Company through OfferMile’ Mark as Hired and Mark as No Longer Working features.

“Sister Platforms” means other platforms owned and operated by Tech Ideas LLC, including TrueConnect, with which OfferMile may share Candidate data.

3. Eligibility

To use the Service, you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction)
  • Be legally authorized to work in the United States if registering as a Candidate
  • Be legally authorized to do business in the United States if registering as a Company
  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your information to keep it accurate

Companies must additionally comply with all applicable federal, state, and local employment laws, including but not limited to the Fair Labor Standards Act, the Civil Rights Act, the Americans with Disabilities Act, and the Fair Credit Reporting Act.

4. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@offermile.com of any unauthorized use of your account.

Each User may only maintain one active account per role. Creating multiple accounts to circumvent fees, screening processes, or other limits is prohibited.

5. Candidate Terms

By registering as a Candidate, you represent and warrant that:

  • All information you provide is accurate and truthful
  • You are legally authorized to work in the United States
  • You consent to background checks, drug tests, and motor vehicle record checks as required by hiring Companies
  • You consent to your profile being searchable by registered Companies
  • You authorize OfferMile to share your profile information with Companies that invite you to interview

The Service is free for Candidates. OfferMile does not charge Candidates fees of any kind.

When a Company marks you as Hired through the Service, an entry is automatically added to your Verified Work History. When a Company subsequently marks you as No Longer Working, the entry is updated with the separation date. You may view your Verified Work History but cannot edit or delete entries that were added by Companies — these entries serve as an immutable, employer-verified employment record.

6. Company Terms

By registering as a Company, you represent and warrant that:

  • You have authority to bind the company to these Terms
  • You will use the Service only for legitimate hiring purposes
  • You will comply with all applicable employment, anti-discrimination, and labor laws
  • You will treat Candidate information with appropriate confidentiality
  • You will not share Candidate contact information or profiles with third parties outside your company’s hiring team

Companies pay a fee for each Candidate they hire through the Service. See Section 9 (Fees and Payment) for details.

Companies are solely responsible for their hiring decisions and for compliance with all applicable laws governing employment, including but not limited to anti-discrimination laws, the Fair Credit Reporting Act, and applicable state and local “ban the box” laws.

7. Partner Terms

Partners participate in the OfferMile Founding Partner program by referring Companies and earning commissions on each qualifying hire. Partner terms, including commission rates, payment schedules, and program-specific requirements, are governed by a separate Partner Agreement provided at the time of invitation.

8. The Service

We provide the Service “as is” and “as available.” We do not guarantee:

  • That Candidates will receive job offers
  • That Companies will find suitable Candidates
  • That Partners will earn any specific amount of commissions
  • The accuracy of information provided by Users (Candidates’ work history, Companies’ job postings, etc.)
  • Continuous, uninterrupted, or error-free operation of the Service

OfferMile is a platform, not an employer. We do not employ Candidates and are not party to the employment relationship between Companies and Candidates.

9. Fees and Payment

The current fee for each Candidate hired through the Service is set by OfferMile and may vary based on Company subscription, promotional pricing, or other factors. The applicable fee is displayed clearly at the time of hiring.

By providing payment information, you authorize Tech Ideas LLC to charge the applicable fees through our payment processor.

All fees are non-refundable, except as required by law or as specifically provided in these Terms. If a Candidate fails to start work or leaves shortly after hire, the Company may use the Mark as No Longer Working feature for record-keeping, but the hire fee remains non-refundable.

10. Verified Work History

When a Company marks a Candidate as Hired:

  • A Verified Work History entry is automatically added to the Candidate’s profile
  • The entry includes the Company name, position title, and start date
  • The Candidate cannot edit or delete this entry

When a Company marks a Candidate as No Longer Working:

  • The Verified Work History entry is updated with the separation date
  • The Candidate sees only the end date, not the reason for separation
  • The separation reason and any internal notes remain visible only to the Company and OfferMile administrators

Verified Work History serves as a tamper-resistant employment record. Companies relying on Verified Work History for future hiring decisions acknowledge that entries are submitted by the prior Company and have not been independently verified by OfferMile.

11. Account Deletion and Data Retention

OfferMile maintains a permanent record of all User accounts and activity for the following purposes:

  • Preserving Verified Work History integrity across Companies
  • Maintaining audit trails for hiring decisions
  • Compliance with applicable employment, tax, and recordkeeping laws
  • Detection and prevention of fraud or abuse

Candidate accounts cannot be deleted by the Candidate. You may:

  • Update your information at any time
  • Mark yourself as not actively looking for work
  • Request to be hidden from Company searches
  • Contact support@offermile.com with privacy concerns

Company and Partner accounts may be suspended or closed by OfferMile, but related transaction and audit records are retained for legal and operational compliance.

By using the Service, you acknowledge and consent to this data retention policy.

12. Background Checks and FCRA Compliance

The Service may facilitate or display the results of background checks, motor vehicle records, drug tests, and similar pre-employment screenings. Companies and Partners that obtain such information through the Service agree to:

  • Comply with the Fair Credit Reporting Act (FCRA) and applicable state and local “consumer report” laws
  • Obtain written authorization from Candidates before procuring consumer reports
  • Provide pre-adverse action and adverse action notices as required by law
  • Use consumer report information solely for permissible employment purposes

Candidates consent to the procurement of consumer reports by Companies that have invited them to interview, subject to applicable FCRA disclosures.

13. Data Sharing with Sister Platforms

Tech Ideas LLC operates other platforms that may share data with OfferMile, including TrueConnect. By using the Service, you acknowledge and consent that:

  • Candidate information you provide on TrueConnect or other Tech Ideas LLC platforms may be imported into OfferMile via API
  • Candidate information you provide on OfferMile may be shared with TrueConnect and other Tech Ideas LLC platforms for operational and service-improvement purposes
  • All such sharing remains within Tech Ideas LLC and is not considered “third-party” data sharing under our Privacy Policy

Tech Ideas LLC does not sell User data to unaffiliated third parties.

14. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Provide false, misleading, or fraudulent information
  • Impersonate any person or entity
  • Harvest, scrape, or collect User data through automated means
  • Reverse engineer, decompile, or attempt to extract source code from the Service
  • Interfere with or disrupt the Service or its servers
  • Use the Service to send unsolicited communications or “spam”
  • Discriminate against Candidates on the basis of race, color, religion, sex, sexual orientation, gender identity, national origin, age, disability, genetic information, veteran status, or any other characteristic protected by applicable law

15. Intellectual Property

The Service and its original content (excluding User-provided content) are the exclusive property of Tech Ideas LLC and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries. Our trademarks may not be used in connection with any product or service without our prior written consent.

You retain ownership of content you submit to the Service. By submitting content, you grant Tech Ideas LLC a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and distribute your content as necessary to provide the Service.

16. Disclaimers and Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Tech Ideas LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months prior to the event giving rise to the claim, or (b) one hundred dollars ($100).

17. Indemnification

You agree to defend, indemnify, and hold harmless Tech Ideas LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney’s fees) arising from (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property, privacy, or employment right; (d) any claim that your content caused damage to a third party; or (e) any hiring or employment decision you make through the Service.

18. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to your breach of these Terms.

Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination (including without limitation ownership provisions, warranty disclaimers, indemnification, and limitations of liability) shall survive.

19. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of such courts.

20. Dispute Resolution

Before filing a lawsuit, you agree to first contact us at support@offermile.com and attempt in good faith to resolve the dispute informally. If the dispute is not resolved within thirty (30) days, either party may pursue formal legal action in accordance with Section 19.

21. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify Users by email and/or by posting a prominent notice on the Service. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those Terms.

22. Miscellaneous

(a) Entire Agreement. These Terms, together with our Privacy Policy and any other legal notices we publish on the Service, constitute the entire agreement between you and Tech Ideas LLC regarding the Service.

(b) Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

(c) Waiver. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

(d) Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

(e) Force Majeure. We shall not be liable for any failure to perform our obligations due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, or government action.
